In general, probate and estate administration are the processes through which a decedent’s assets are transferred after death. Unfortunately, during this process litigation may arise. Probate litigation may arise over standing issues when a petition for letters of administration are filed (when no will is present), or, if there is a will, when a will is petitioned for probate. Probate lawsuits can also occur concerning the validity of a will, including involving either the execution of the will itself or the mental capacity of the decedent at the time of the will’s execution. Even after a will is probated, probate disputes may arise as to whether an appointed fiduciary (an executor, administrator, or a trustee) is acting in compliance with the various governing fiduciary duties.
